“What are private family law proceedings?” is one of the most common questions I come across. There are three types of procedures for children:

So before you take the first step towards legal action, let’s take a look at some of the most common misconceptions about family law.
The law does not favor one parent over the other when it comes to custody. Care is decided by assessing what is best for the child.
However, often both parties decide that the mother has more nighttime custody than the father. This is not necessarily ordered by the court, but a conclusion reached through mediation. Usually, this path is chosen for some sociological reason, and often the agreements reflect the role each party played in the relationship prior to separation.

So while many mothers tend to spend more time with their children, it is usually decided by both parents through mediation and not by court order. As far as the law is concerned, mothers do not get special treatment.
Although it may represent a more dramatic journey in movies and TV shows, in reality most family law cases are settled out of court. All good lawyers will encourage you and your partner to try to reach an agreement through mediation or settlement. This option is much cheaper and emotionally kinder for all parties involved. Therefore, the court is usually used as a last resort if the parties cannot reach an agreement.

So, as you can see, there are many factors that affect the division of assets, and it very rarely results in each partner receiving 50% of the couple’s assets.
It doesn’t matter whether your name or your spouse’s name is on the papers, any property owned by either party is considered relationship property. This applies to everything from houses and land to cars and bank accounts.

This applies regardless of whether you or your spouse own the assets. For example, if you are divorced from your partner and live in one of their properties, this does not mean that you will receive said property in the settlement.
Contrary to what you may have seen in the movies, Australia is a fault jurisdiction for property division, child custody and other divorce matters. Moral issues such as infidelity do not affect how wealth is divided or who children live with. So even though an affair partner can directly lead to the dissolution of a marriage, the law does not penalize the involved partner in divorce proceedings.
